Default Waiter used my credit card.

I was recently dining in a restaurant with my girlfriend. For payment of bill i used my mastercard. Four days later i was checking the status of my account when i saw that 400$ had been debted extra to my account. I called up the bank and they froze my account. Will i get my 400$ back as i didnt spend them?

Checkout the policies of your bank for this question. And as you didnt authorise the transactions with your signature they all should be null and void although contact your bank for more on it.

File a dispute with your bank and tell them that you didn't spend the money and hopefully you will get the money back. Also never give credit card to waiters, always ask them to punch infront of you so they don't get your cvv2 number.

If it is your credit card you will get it back no problem, as just about any credit granter has policies to protect against unauthorized charges. If it was your debit card you may be liable for the first $50 unless you give your bank hell, which is why I hate debit cards.

credit cards tend to be safer in such places i feel because we can file chargebacks..

i doubt if using debit cards the bank would refund the amount or atleast do a partial refund..

I'd also suggest you report it (nicely) to the manager of the restaurant.

It may stop it happening to someone else.

Credit cards are easier to deal with, but depending on the bank, they may refund the amount on the debit card. I know WAMU will investigate and get you the money back right away and as long as you do the paperwork in a timely manner, you should be refunded.

I'm not sure about that, did you made the CC payment. In case the bank took the amount from your account, the situation might be acute.

Most of the banks issuing credit cards to the customers have a rule to accept only those slips which have customer's signature on them otherwise refuse payments
