Default Ever have a costumer wrongfully chargeback on you?

I have. I sent the product- it was $400- in the mail and the costumer claimed to have never gotten it. Paypal did a chargeback on me. For some reason they never got the money from me. I think it was because I didn't update my credit card information after it expired. Thank goodness! I knew I sent it so I'm glad I wasn't out of the product and the money.

I sold an item for a little over $5000 a month ago, fedex tracking shows it was delivered and signed for, with signature image and and all. It was shipped fully insured to the full value, and packaged professionally by the shipping location. Shipped to a verified paypal address. The day after it was delivered the buyer left positive feedback. I gave three days to return it if not completely happy. Apparently the buyer was happy with it, because it was never returned and I didn't hear a thing.

Now, a month later, the buyer tried to initiate a chargeback, claiming it never arrived! Fortunately, the chargeback failed due to lack of funds (I don't keep that kind of money in a back account tied to paypal, having been warned about chargeback fraud before), and paypal is 'investigating'. (Yeah, sure.) I much rather have them try to get money from me in a fraud than me trying to recover from them!

Not sure where this will lead. I actually found this site while googling for an attorney who specialized in chargeback fraud, if they exist, or to find other legal options. I may need an attorney to subpoena paypal to provide the card issuer (who they keep secret), and then pressure the issuer to back off. Anyone know of legal counsel who can drive this? I'm located in SF, CA.

Edit: sorry if this is the wrong place, it might really belong in the paypal section...

I've never had a customer charge back on me but I'm sorry to hear that this has happened. Well I would try to fight the issue and if not all you can do is cut your loses learn from it and keep on going.

Yep, I did dispute it and paypal actually stepped up to bat for me. Between the many private messages suggesting I ship USPS instead of Fedex (in hindsight because USPS Prio Mail isn't trackable), the positive feedback saying it was just as advertised (on the day after receipt), the return period I offered, no correspondence for a full 30 days wondering where the 'missing' shipment was, and an attempt to chargeback on the 2nd of a month (most people get paid on the first but their mortgage payments haven't deposited yet, so this is when they have the largest balance) -- the buyer dropped the chargeback. It was just too obviously fraudulent.
