Default Customer ripped us off

I am doing some internet research for my husband who got ripped off by a customer on ebay because of a bogus chargeback.

My husband has done hundreds of transactions on ebay for several years and had a 100% positive feedback with quite a number of reviews on it. He bought a PC off of ebay, actually, and changed his mind and wanted a Mac, so he put the PC up for auction. His policy stated that shipment was only to the 48 mainland states, no international, Hawaii or Alaska shipping. Well somehow a guy in Hawaii won the bid. My husband decided to go ahead and give it to him, but then paid quite a bit extra in shipping and just ate it. He made sure everything was intact and wrapped that sucker up good and made sure to get insurance on it. It included a nice monitor and speaker system, wireless mouse and wireless keyboard.

Several weeks later the guy emails him and says that there's a crack in the case and that the hard drive was not screwed in. My husband says he actually checked and made sure the hard drive was intact prior to shipping and that there was no crack prior to shipping. The guy complained again and my husband said that a claim can be sent to the insurance. The guy acts like my husband is scamming him, which things are starting to sound fishy to us (like, why didn't he email us when he got the package?). My husband told him to take pictures and he didn't, or if he did, he never sent them to us. Even though the policy stated no refunds, the guy did not even try to request a return. All of a sudden, Paypal contacts my husband to let him know that the guy has requested a chargeback. Paypal refuses based on the evidence (of course), but the guy's credit card company says "sure!", so they charged paypal who in turn charged my husband, so now he's negative several hundred dollars with no merchandise returned! The guy has blocked my husband's email and won't respond to ebay messages, despite my husband's effort to try to negotiate a return. That makes me think that he's just scamming us. He said "product was not as described", and even if it's because it got damaged in shipping, he still needs to return it!

This guy stole from my husband and I'm miffed. How can credit card companies just believe their customers without any proof?!? I can't believe this happens. Does anybody know what we can do to dispute this so that we get the money back or at least turn the guy in for theft?

Any help would be appreciated,

I can suggest you a way. As the dispute was for "product was not as described", there are couple of pre-requisite conditions for using this reason. They are Cardholder or authorized representative attempted to return merchandise, cancel services, or resolve a dispute for services rendered. From your explaination given, it seems that the product was not returned, nor the customer contacted you to resolve the dispute. Hence these are strong points in your favour.

Contact local law enforcement and file a report. Speak with you card holder and tell them that there was a unauthorized charge and it needs to be disputed. that's where I would start.

If I were you, I will get a lawyer for this case, although it might cost you a lot but you'll still need their service...

I think we are throwing ideas, rather than giving solutions............. if you want to solve the problem, the way i suggested would be more appropriate....

Well, maybe you're right here, mate. However, there are more than one way to solve up this problem...Thus, if he/she had tried the way you've suggested and it didn't worked, then he/she still can try the others...
