Hi everyone, I am new here, and I am a merchant as well as a customer.
I bought a diamond ring Feb 12, 2010, at a cost of $1760USD from Engagement Rings, Diamond Rings, Diamond Engagement Rings Purchased with a debit VISA card through Chase. I returned it once for resizing. It came back in a worse condition, so I sent it back again to be fixed (my shipping cost) and it came back clearly damaged. Small diamonds had obviously fallen out and been squeezed back on with pliers! I am now asking to return the ring and be credited back the cost of the ring. Merchant return policy is 30 days, and they state we are outside of the return policy. I state that they have damaged the ring and shown it to be poor quality, therefore falling under Chargeback reason code 53: "Not as Described or Defective Merchandise."
Can I chargeback if they won't cooperate? They said they would give me a new one rather than repair the old one yet again. I know that even a new ring will end up in poor condition based on the quality they have shown me. Am I right to be able to chargeback for this? I just want to send them back their ring and get my money back.
Any help would be appreciated as it is coming up to 60 days now.
