Thread: Can I Chargeback?

Thanks in advance for advice. I recently ordered some clothing from a company in Hong Kong, yesstyle.com. I used a Citi Visa card.

Anyways, the item I got was a knock off of pretty terrible quality but not defective. It is basically a knock off designer item even though they do not advertise it as so. The label on the item was a completely different name than the designer they list it as.

Also, the actual measurements of the item do not match the measurements listed on the web site. Thus it is too small for me. For example, chest is listed at 98cm but actual measurement is about 93cm.

On the product page it does say "NOTE: This fashion brand sources its items from a number of independent suppliers and designers. As such, the products may possess different brand labels than the indicated brand." Which is basically a shady way of saying they sell knock offs.

Anyways, they will let me return the item but only for store credit. Their terms of service do say they do not provide cash refunds. I don't want store credit for this shady company that sells knock offs. Is there any way I can win a chargeback under the basis of product not being as described or am I out of luck?

More than likely you would win the chargeback. If the merchandise was not advertised as a knock off and that’s what you received, you would have ever right to issue a chargeback for “Merchandise not received as described” while their policies may be clear, you still have a right to a full refund because of their misrepresentation of the merchandise from what you described. I would suggest that you contact your bank and explain the situation; they should be able to help you and if you don’t get satisfaction at that point, call +1 (212) 751-6213 and ask for a chargeback specialist.

Yes, I would definitely chargeback in this situation. With an international seller sending shoddy merchandise, you're almost guaranteed success. It's very difficult for merchants to dispute chargebacks, and especially since you have the email proving you offered to deal with them directly and they offered useless store credit, it's a shoe-in.

You should win the charge back pretty easily, as long as you return the product.

i dunno man, sounds to me like you had this coming to you...you were obviously ordering from this Hong Kong website because it was 10x cheaper than the "real" cost , you read : "NOTE: This fashion brand sources its items from a number of independent suppliers and designers. As such, the products may possess different brand labels than the indicated brand."....no cash refunds....how many more signs do you need?????? you should have expected this.
