Thread: Can I file chargeback if merchant won't allow me to cancel order before item shipped?

I ordered something on eBay and paid by credit card. The seller has no return policy.
The item will be ship in 1 month. On the next day after I ordered, I immediately contact the seller to cancel the order, but he refused to cancel the transaction and won't issue a refund no matter what.

If I file a chargeback now before the item is shipped, will the credit card company think it is a buyer remorse and rule in the seller's favor?
Or should I wait until the seller ship the item and I refuse to accept the item and then file the chargeback?

In the UK we have Distance Selling legislation that allows us the legal right to cancel goods within 7 days of receipt. Don't you have anything like this in your country? In any case I'd contact your credit card company and ask them.

I live in the US. I just tried to research online, but it seems that buyer's remorse is not covered by chargeback, but I am not sure thought.
I want to do more research before contacting my credit card company.

Have you asked your credit card company about this? I'm sure they have a policy for case like this where you can ask for a chargeback within 7 days of purchase
