Can you sue Credit Card company for being accessory to theft?

I built a website and this client charged back six months worth of payments after i delivered the website. I provided the credit card company with before and after pictures of the site, client files, everything and today I just got word that the credit card company decided in the the customers favor. I'm going to file suit against the customer but can't I add the credit card company to the suit as well as an accessory?

Not sure about the credit card company. Did you end up also providing copies of all communications (I am guessing this was hired/dealt with to your client via email)? What about copies of invoices for paid work complete with details of the project?

You might be setting a precedent by also suing the "accessory" to the theft. Good for you! Assuming the credit card company received all the documentation proving that you completed the job as expected, they certainly sound complicit to me. Did the credit card company respond in any way that would indicate they even examined the files you provided?

I'd say that it's at least worth giving it a go because, if the credit card company have anything at all to hide, they will almost certainly settle out of court in some way that will benefit you.

I gave paypal(my merchant account) all the information i have( I had over 15 peices of documentation which included before after pics, emails from the client approving the different stages, etc etc) paypal says that they fought it but they have to abide by the credit card companies decision. they also won't give me the cc companies info so i can contact them directly. For all I know paypal didn't even disuput it.

I'm seriously considering this. I honestly beleive that the current system for merchant chargebacks are absolutely unfair(one of the reasons why i started chargebacknation.com) and I really want to get a precedent set in court that could hinder this. Any ideas?

Also, is there any amount limitations? To make a serious impact and even get some media exposure, I'd like to sue high. Even if I can't win, at least i can get the word out.

    Good for you!

I think you may actually have a case here. You have all the evidence that you need to make file a suite- the fact that you have printed out your client's responses to the stages of development will be especially useful. Price-wise, I wouldn't really know how much to aim for. At least get the amount that you were due and extra for the whole chargeback problem.

CashMoney, that's pretty ridiculous. Using your business to blackmail people into paying. There are better ways of handling things.

As for suing the credit card company, that's going to take a lot of money. In the end I'm sure much more than you'd recover I'm assuming. You MIGHT be able to win and set a precedent but at what cost is that worth to you?

its not ridiculous when you spent hours of your time doing real work for someones website and then they think they arnet going to pay for it. especially when it gets them real results

i can not sue these people or have any payment processor back me, its virtually impossible. why should we be afraid to stand our ground on our own terms, they agreed to it, i told them consequences if they didnt pay, they still agreed, im doing it out of generosity - you should never do seo work without payment.

don't make me out like the bad guy. you think i would actually let someone get away with me doing hundreds of dollars worth of seo work for their site, especially when it involves link building, get away with getting all that valueable traffic on my dime?

its hard for us to get backed for "virtual services" by these stupid processors. that is absolutely ridiculous right there, 6 months chargeback that is just crippling!

anyways this is first and only time im doing it will see what happens.

this is why alot of people put backdoors in the script in case mofo's don't want to pay or for worse reasons down the line. Like chargebacks like this!

i bet OP wishes he had a backdoor now
